THE Australian Taxation Office has increased prosecutions targeting shadow economy operators who fail to lodge tax returns, with successful cases jumping more than 80 per cent. Over the past two years, the ATO successfully prosecuted more than 350 individuals and entities, secured more than 305 convictions and prompted courts to impose more than $2.7M in fines. NSW accounted for 20 per cent of successful non-lodgment prosecutions in 2025–26. ATO Assistant Commissioner Tony Goding warned deliberately avoiding tax and super obligations undermined legitimate businesses and reduced funding available for essential community services.
